• ANNEX 1 - MANDATORY CONDITIONS

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in                          respect of the premises licence, or 

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

   

   

   

   

   

               

• Licensing Objectives

   

  Below are the additional steps that you have agreed to undertake in the Marquee Area Only to promote the four Licensing Objectives and which form a part of the operating schedule for the Marquee part of these premises: -

   

  1.  The music shall only be provided by an in-house, fixed system.  Equipment brought in or provided by a "Disco" company, a live group, or a DJ shall not be permitted.

  2.  The final volume control for the system shall be provided by an automatic compressor-limiter device that can only be accessed or adjusted by senior management.  This can be provided by a locked or pasword protected compressor limiter or amplifier controls that are locked away from staff and members of the public.

  3.  The limiter shall be adjusted so that the maximum level shall not exceed LA 80 dB when measured at 1 m from any loudspeaker. (NB if pink noise is used to set the system then the target level shall be LA 75 dB)

  4.  Bass-bins, sub-woofers and other similar bass reinforcement systems shall not be permitted.

  5.  The control system shall be validated at least annually.

   

   

• Conditions added on Variation 7th May 2014

   

  A CCTV system is maintained that conforms to the provisions of the data Proection Act 1998 and meets the requirements and expectations of the Licensing and Police Authorities. The System must operate at all times the premises are open. recordings are kept for a minimum of 28 days. In the absence of the premises licence holder a responsible member of staff is trained in how to use the system and capable of retrieving recordings for an officer of a responsible authority.

   

  The Challenge 21 age verification scheme is utilised whereby any person who does not appear to be at least 21 years of age must provided ID in the form of either a photographic driving licence, a passport, a HM Forces ID card or an ID card incorporating the PASS logo.

   

  A written record of staff training is kept of relevant responsibilities inder the Licensing Act 2003 including who and when trained.

   

  ARrefusals Register and Incident Log is is kept up to date.

   

  A minimum of two SIA registered door supervisors to be employed at the premises when the premises is open for business to the public from 23:00 until the close of business on Friday and Saturday evenings. On any other evenings the business is open for business to the public the premises licence holder will risk assess the need for registered SIA door supervisors.

   

  There will be no admissions or readmissions after 4am.

• The following mandatory conditions are to be applied to the licence stated above in accordance with The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2014.

  The following conditions shall come into force on 28th May 2014

  1.  A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  2. For the purposes of the condition set out in paragraph 1-

                (a) “duty” is to be construed in accordance with the Alcoholic
                    Liquor Duties Act 1979
                (b) “permitted price” is the price found by applying the formula-

                                             P = D + (DxV)

  Where -

       (i)   P is the permitted price,

        (ii)  D is the rate of duty chargeable in relation to the alcohol as if
               the duty were charged on the date of the sale or supply of the
              alcohol, and
       (iii) V is the rate of value added tax chargeable in relation to the
              alcohol as if the value added tax were charged on the date of
              the sale or supply of the alcohol;

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence -

                (i) the holder of the premises licence,
              (ii) the designated premises supervisor (if any) in respect of
                    such a licence, or
              (iii) the personal licence holder who makes or authorises a
                    supply of alcohol under such a licence;

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

  3.  Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

  4.  (1)  Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

       (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
