• ANNEX 1 - MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises supply of alcohol

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in                          respect of the premises licence, or 

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

• Conditions Attached following Hearing

   

  That a CCTV system be installed on the premises covering all the licensed areas including inside the outbuilding used for smoking and described by the Licensee as the "cow shed".  There should be signage in each room to state that CCTV is in operation on the premises.  The system should be digital and operating at all times the premises is open for business; sany recordings are to be handed over to the police on request and without delay and are to be retained for one calendar month,

   

  That the premises become a member of the Northampton Pubwatch Scheme and adhere to its rules.

• Licensing Act 2003

   

  This licence is granted on the condition that the restrictions contained within the enactments specified under the Licensing Act 2003 Schedule 8 (1 & 6) are adhered to.

   

• REVIEW APPLICATION 5th January 2012

   

  Northamptonshire Police a responsible authority has applied for the REVIEW of a Premises Licence under Section 51 of the Licensing Act 2003 in respect of The Prince of Wales, 101 Harborough Road, Northampton, NN2 8DZ

   

  The grounds for the review are to secure the Licensing Objectives of Preventing Crime and Disorder and the Prevention of Public Nuisance, due to incidents at the premises.

   

  Any interested party or responsible authority wishing to make representation must do so in writing to the following address by the 3rd February 2012.

  A copy of the application for the Review of the above Licence is kept by the Licensing Authority at the above address.  The application can be viewed Monday to Friday 9am to 5pm, except Bank Holidays.

   

  It is an offence knowingly or recklessly to a make a false statement in connection with an application.  The maximum fine for which a person is liable on summary conviction for making a false statement is a Level 5 fine (£5,000) on the standard scale.

• LICENSING SUB COMMITTEE 21st February 2012 - NOTICE OF DETERMINATION

   

  RESOLVED:

   

  Having regard to the Licensing Act 2003 and the guidance thereunder; the Council’s Licensing Policy statement and the representations made, the following decision was reached:

   

  The Sub Committee thanked all of the participants for attending the Licensing Sub Committee Review of the Prince of Wales.

   

  It was noted for the record that the Prince of Wales had had sufficient notice of the hearing and that Mr Bampkin, the holder of the Premises Licence had been made aware of the hearing. No one from the Prince of Wales, nor any representative had attended.

   

  On a balance of probability the Sub Committee was satisfied that the current operation of the premises is not promoting the Licensing Objectives of the prevention of crime and disorder and the prevention of public nuisance.

   

  Therefore the Sub Committee decided that it was appropriate and proportionate to revoke the premises licence from the Prince of Wales particularly given PC Bryan’s view that the current situation at the Prince of Wales cannot be redeemed.

   

  This decision takes effect 21 days after receipt of this notice.

   

  In the meantime the Sub Committee urged the Fire Officer to urgently review the public safety concerns at the premises and take whatever appropriate action thought necessary.
