Conditions As Per Operating Schedule as Amended with By Agreed Police Conditions
CCTV:
1. The premises shall install and maintain a comprehensive CCTV system. All entry and exit points will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. Viewing of recordings shall be made available immediately upon the request of a Responsible Authority officer throughout the entire 31 day period.
2. A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises is open. This staff member must be able to provide a Responsible Authority officer copies of recent CCTV images or data 24hrs when requested, in line with current Data Protection legislation.
3. There shall be a Security Industry Authority registered member of door staff employed at the venue between the hours of 01:00hrs and 06:00hrs 7 days per week.
4. All sales of alcohol for consumption off the premises shall be in sealed containers only and shall not be consumed on the premises.
5. The Premises Licence Holder shall ensure that customer areas are well lit and kept free from obstruction at all times when the Premises is open to members of the public.
6. A Challenge 25 proof of age scheme shall be operated at the premises where the only acceptable forms of identification are recognised photographic identification cards, such as a driving licence, passport or proof of age card with the PASS Hologram.
7. The Premises Licence Holder will prominently display signage at the entrance to the Premises and at point of sale advising customers of the Challenge 25 proof of age scheme in operation at the Premises.
8. The Premises Licence Holder will prominently display signage at the entrance to the Premises and at point of sale advising that it is illegal to purchase alcohol on behalf of persons under the age of 18.
9. An incident log shall be kept at the premises, and made available on request to a Responsible Authority officer. It must be completed within 24 hours of the incident and will record the following:
· all crimes reported to the venue;
· any ejections of patrons;
· any complaints received concerning crime and disorder;
· any incidents of disorder;
· any faults in the CCTV system, searching equipment or scanning equipment;
· any refusal of the sale of alcohol; and
· any visit by a relevant authority or emergency service.
10. Deliveries:
a) The Premises Licence holder shall carry out due diligence checks to ensure, as far as practicable, that a person ordering alcohol to be delivered to their registered address, or
collecting pre-ordered alcohol from the premises, is over 18 years of age. A record of each order and the checks carried out by the staff at the premises shall be kept either in a
book or electronically and made available to Police, Local Authority Licensing and Trading Standards officers on request.
b) Internet sales / deliveries shall only be permitted to a registered address, not parks, open spaces or vehicles. If the sale contains alcohol, Challenge 25, Proof of age Photo ID
must be validated by the person delivering the alcohol prior to it being handed to the customer.
c) If the premises has a website there must be a clear warning advertised that no sales of alcohol shall be made to persons under 18 years of age.
d) Alcohol deliveries by staff from the premises shall only be carried out by persons who have undergone appropriate Challenge 25 training.
e) If deliveries are carried out by an external contractor a contract shall be in place ensuring that they train their delivery staff in line with current legislation relating to underage
/drunkeness.
11. Prior to undertaking any work at the Premises, paid or unpaid, the Premises Licence Holder shall undertake a right to work check on any prospective employee to make sure that he or she has the right to work in the UK. The Premises Licence Holder will record this check in the Premises’ Right to Work register a copy of which shall be kept at the Premises and made available for inspection by a Responsible Authority officer on request. It shall record the following:
· The name of the employee
· The date of birth of the employee
· A copy of the employee’s photographic ID document proving his or her right to work in the UK
· The date upon which the employee’s status is to be reviewed and his or her right to work in the UK re-confirmed.
12. Controls of alcohol:
a) A till prompt system shall be installed to assist staff by reminding them to challenge for ID when a sale is made.
b) There shall be no supply of alcohol for consumption off the premises except in sealed containers.
c) The Premises Licence holder, the DPS or a nominated person shall be present at the premises at all times during licensing hours.
d) Documented delegation of authorisations to sell alcohol shall be maintained at the premises and shall be available on request by an authorised officer of the Licensing Authority or
the Police.
e) Spirits shall be located behind the counter. All other alcohol exposed for sale shall be displayed in a position that is not obscured from the constant view of the cashier / staff or CCTV by fixtures.
f) There shall be no self-service of spirits.
13. Prior to undertaking any work at the Premises, paid or unpaid, the Premises Licence Holder shall ensure that any prospective employee is trained in the following:
· The Licensing Act 2003 and the Licensing Objectives
· The Conditions of this Premises Licence
· Underage sales of alcohol and tobacco and the Premises’ Challenge 25 policy
· Proxy sales and sales of alcohol to persons who are drunk
· Identifying non-duty paid products
14. Employee training shall be repeated every six (6) months and must take place at least twice in every calendar year.
15. The Premises Licence Holder shall record all employee training in the Premises’ Employee Training Register a copy of which shall be kept at the Premises and made available for inspection by a Responsible Authority officer on request.
16. Refusals Book:
a) The licensee shall keep a register of refused sales of all age-restricted products.
b) The refusals book shall contain details of time and date, description of the attempting purchaser, description of the age-restricted products they attempted to purchase, reason
why the sale was refused and the name/signature of the sales person refusing the sale.
c) The Refusals Book shall be kept on the licensed premises and made available for inspection by the Licensing Officer, Trading Standards or the Police on request.
