• ANNEX 1 - MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises supply of alcohol

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in                          respect of the premises licence, or 

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

• Police Conditions

   

  1              The operator of a premise, designated premise supervisor or duty manager shall maintain a register indicating the name of person in charge of the management of the premise, numbers of staff, performers and door supervisors, including names & SIA License numbers of door supervisors, who are present when the public are present.  Further the register will contain detail regarding any incident relevant to the four licensing objectives.  This register shall be produced immediately on the request of an authorised officer.

   

  2              The operator in order to secure the integrity of the licensing objective the prevention of crime & disorder shall ensure that bottles, glasses and other open containers are not taken from the premise unless the practise is specifically authorised by the premise license.

   

  3              At peak time and critical times, that is when the licensing objectives namely the prevention of crime & disorder and public safety is or is likely to be compromised, the capacity limit is maintained so as to be conducive to the keeping of good order on the premise.

   

  4              To co-operate fully with any agency to ensure that the promotion of the four licensing objectives is actively supported by the use of crime prevention notices and similar.

   

  5              Sales promotions or discounting of alcoholic drinks can be instrumental to creating the circumstances whereby the promotion of the four licensing objectives is disregarded.  Therefore, the operators of premises that promote such practice have an added positive responsibility to monitor incidents relevant to the licensing objectives and introduce control measures as necessary to prevent offences of drunkenness and disorder being occasioned.

   

  6              To prevent incidents of crime and disorder an expectation prevails that the operators of premises and their staff will at all reasonable times co-operate fully with the Police and other enforcement agencies and take steps to ensure that members of their staff understand the importance of the responsibility they hold.

   

   

• ANNEX 1 - MANDATORY CONDITIONS

   

  Mandatory condition: exhibition of films

   

  (1)              Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.

   

  (2)              Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  (3)              Where -

   

  (a)              the film classification body is not specified in the licence, or

  (b)              the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,

   

  admission of children must be restricted in accordance with any                  recommendation made by that licensing authority.

   

  (4)              In this section -

   

                “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39)

  (authority to determine suitability of video works for classification).

• Licensing Act 2003

   

  This licence is granted on the condition that the restrictions contained within the enactments specified under the Licensing Act 2003 Schedule 8 (1 & 6) are adhered to.

• Licensing Objectives

   

  Below are the additonal steps that you have agreed to undertake to promote the four Licensing Objectives and which form a part of the operating schedule for these premises: -

   

  General - The contracted door supervisors would be required to work til the bar closes and the customers have left.   Pubwatch - we are members and will continue to be. 

  Prevention of Crime and Disorder - Contracted door supervisors (SIA recognised) will work seven nights a week.  All door staff and duty managers wear radios so they can communicate to each other.  The CCTV is internal and external which is recording 24 hours per day and is always freely available to the Police if ever needed.  The use of the Pubwatch radio which is linked to Northampton CCTV control room.  Regular communication with the Licensing Officer to keep both him and us aware of any crime and disorder in the area.

  Public Safety - Notices up to say to customers that if they feel uncomfortable because of another customer, then they can go and inform a duty manager or a member of the doorstaff team.  Fire alarm with sensors throughout the venue (incl. toilets).  If the fire alarm goes off, the music gets silenced automatically allowing customers to hear and evacuate safely and calmly.  All staff have been trained in fire evacuation and regular updating/training will continue.  Bright emergency lighting over fire exit points.  All fire equipment regularly checked.  Continuous first aid training for all duty managers.  Binge drinking through promotions will constantly be monitored through staff training.

  Prevention of Public Nuisance - Strict door policy.  Using contracted door supervisors, seven days a week (all SIA recognised).  Random searches will be performed by door supervisors so that drugs or dangerous weapons will not enter the venue.  Regular attendance at Pubwatch meetings so managers/licensees/doorstaff are aware of any people being banned on Pubwatch, due normally to public nuisance.

  Protection of Children from Harm - Children (0-17yrs) will remain with accompanied adult at all times if this is not adhered to, they (adult and child) will be asked to leave NB's.  Children will only be allowed in the venue when they are accompanied by an adult (18+years).  ID (valid passport or photo driving licence) will be asked off the accompanying adult if they are deemed to look under the age of 21 years.  No person under the age of 18 years will be allowed to consume alcohol even if it’s with a meal. 

   

   

• Conditions following Hearing 10th December 2009

   

  1. That Northamptonshire Police Licensing Officers (Northampton Area) are notified in writing, within 48 hours, of all Door Supervisors and Security Staff employed at the premises (whether directly or through a security company), this list should include names in block capitals and full SIA Licence numbers.

  Should any of those Door Supervisors or Security Staff be subject to any criminal investigation, they shall be suspended immediately and disallowed from working at the premises until the completion of the investigation.  Should the Door Supervisor or Security Staff be found guilty of such criminal investigation or any Public Order offence or any racially aggravated offence, they shall be forbidden from working at the premises.

   

  2. Door Supervisors shall be employed at the following ratio when the premises are open to the public between 22:00 hours and close of business - at least two Door Supervisors for the first 200 customers and one per 100 (or part thereof) thereafter.

   

  3. Door Supervisors will wear high visibility jackets or polo shirts whether working on the outside of the premises or inside and to include the garden area.  High visibility armbands to be used in conjunction with the outer garment.

   

  4. Colour copies of the SIA Licence of all Door Supervisors employed at the venue (directly or through a security company) are to be kept on the premises and available for inspection at the reasonable request of a police officer or other authorised person.

   

  5. Under the part "Prevention of Public Nuisance" the words "strict door policy" are replaced with a "condtion of entry policy is adopted and a copy published on permanent display at all points of entry".

   

  6. A Personal Licence Holder id present at all times when the premises are open to the public.

   

  7. That the premises adopt a recognised proof of age policy and training records are completed on a monthly basis.

   

  8. A member of staff trained in first aid is present at all times whilst the premises are open to the public.

   

  9. Signage in relation to the use of CCTV to be displayed in public areas.
