Conditions imposed following review of premises licence (July 2024)
1. The premises shall install and maintain a comprehensive CCTV system. All entry and exit points will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. Viewing of recordings shall be made available immediately upon the request of a Responsible Authority officer throughout the entire 31 day period.
2. A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises is open. This staff member must be able to provide a Responsible Authority officer copies of recent CCTV images or data 24hrs when requested, in line with current Data Protection legislation.
3. The premises licence holder shall ensure that customer areas are well lit and kept free from obstruction at all times when the premises is open to members of the public.
4. A Challenge 25 proof of age scheme shall be operated at the premises where the only acceptable forms of identification are recognised photographic identification cards, such as a driving licence, passport or proof of age card with the PASS Hologram.
5. The premises licence holder will prominently display signage at the entrance to the premises and at point of sale advising customers of the Challenge 25 proof of age scheme in operation at the premises.
6. The premises licence holder will prominently display signage at the entrance to the premises and at point of sale advising that it is illegal to purchase alcohol on behalf of persons under the age of 18.
7. An incident log shall be kept at the premises and made available on request to a Responsible Authority officer. It must be completed within 24 hours of the incident and will record the following:
• all crimes reported to the premises;
• any ejections of patrons;
• any complaints received concerning crime and disorder;
• any incidents of disorder; • any faults in the CCTV system
• any refusal of the sale of alcohol; and 5
• any visit by a relevant authority or emergency service.
8. Prior to undertaking any work at the premises, paid or unpaid, the premises licence holder shall undertake a right to work check on any prospective employee to make sure that he or she has the right to work in the UK. The premises licence holder will record this check in the premises’ Right to Work register a copy of which shall be kept at the premises and made available for inspection by a Responsible Authority officer on request. It shall record the following:
• The name of the employee,
• The date of birth of the employee,
• A copy of the employee’s photographic ID document proving his or her right to work in the UK and • The date upon which the employee’s status is to be reviewed and his or her right to work in the UK re-confirmed.
9. Prior to undertaking any work at the premises, paid or unpaid, the premises licence holder shall ensure that any prospective employee is trained in the following:
• The Licensing Act 2003 and the Licensing Objectives,
• The conditions of this premises licence,
• Underage sales of alcohol and tobacco and the Premises’ Challenge 25 policy and
• Proxy sales and sales of alcohol to persons who are drunk.
10. Employee training shall be repeated every six (6) months and must take place at least twice in every calendar year.
11. The premises licence holder shall record all employee training in the premises’ Employee Training Register a copy of which shall be kept at the premises and made available for inspection by a Responsible Authority officer on request.
12. There shall be no self-service of spirits on the premises.
13. No alcohol or tobacco products will be purchased from unknown sources such as itinerant traders “cold callers” at the premises. A notice shall be displayed close to the entrance to the premises (either on a shop window or door) which clearly indicates that alcohol and tobacco products will not be purchased from “cold callers” visiting the premises.
14. All alcohol and tobacco products will be purchased from the bona fida wholesaler. All such purchases will be accompanied with official invoices which will allow full traceability through the supply chain alongside any applicable AWRS scheme number for that supplier. Invoices will be retained on the premises for a minimum of six months and will be provided on request to a police officer or authorised officer of West Northamptonshire Council.
15. The premises licence holder and/or the designated premises supervisor will ensure that all staff are instructed and trained on the subject of illicit alcohol and tobacco products, including periodic refresher training. Records of the training will be made and kept up to date and checked on a regular basis by the premises licence holder and/or designated premises supervisor.
16. A minimum of two members of staff must be on duty at all times when the premises is open for licensable activity. One of these members of staff must hold a current personal licence.
17. There will be no sales of beer, lager or cider over 6% ABV. Spirits will not be sold in quantities of less than ½ litre. Wine will not be sold in quantities of less than 75cl.
18. There will be no window display posters or similar advertising containing any reference to alcohol on the premises shop frontage or the highway abutting the premises
19. There will be no single can sales of beer, lager or cider
20. Public access to the premises will only be possible via the main entrance as the rear door will be kept closed. This door has a code lock fitted so that only staff on duty will be able to gain access to the shop from the rear service yard. The gates to the rear service yard will be in operation and be closed except for the use of persons accessing the commercial units or residential flats. This will deter unauthorised access to the area behind the shop.
21. The premises will have a security alarm to enhance the multilocking capability of the front and rear doors and the security shutters in evidence at both the front and rear.
22. Staff will actively engage in discouraging all customers from congregating outside the premises should such an occasion arise. This is to prevent the main entrance and the footpath from becoming obstructed and maintain unhindered access to the shop premises. Notices will be displayed in the shop window reminding customers outside not to obstruct these areas. Liaison will be maintained with the Police to highlight any particular individual or individuals that may not comply with that requirement. The presence of a CCTV camera outside the premises will assist in that regard. Staff on duty will ensure that the front of the premises are checked regularly and that any litter is cleared away. Similarly, staff checks to the rear of the premises will see that the service yard access gates are closed. A notice on the gates will advise persons that there is no public access to the shop premises by the service yard access gates.
