Licence Conditions (As amended by committee on 17th April 2018)
The premises Licence holder ensures that the attainment of the Licensing Objectives forms an integral part of the day to day management policies and practises at the premises.
A CCTV system is operated and maintained that conforms to the provisions of the Data protection Act 1998 and meets the requirements and expectations of the Police and Licensing Authorities. The system opersates at all times the premises are open. Recordings are kept for a minimum of 28 days and a member of staff who is trained and able to retrieve recordings from the CCTV system upon reasonable request of an authorised officer.
A Member of staff who is trained and capable of dowloading images must be on duty at all times the premises is open to the public.
A working Intruder alarm is in operation at the premises.
Drinks are not sold in open containers, spirits must be displayed behind the sales point and are not available for self service.
Any individual identified as a street drinker is refused service.
Licensing Committee Conditions Review 17th September 2016 - Consent Order (As amended by committee on 17th April 2018)
Staff training in relation to the four Licensing Objectives is given to all staff employed in the sale of alcohol prior to commencement of their employment in this capacity. This includes training in respect of the law and the penalties for underage sales of alcohol and other age related products, and the law in relation to sales to drunks. This training is documented to include syllabus, person receiving with their signature and date training received and the person providing the training. Training is refreshed every 6 months and the date of this shall be also documented.
A Challenge 25 policy is adopted by the premises and signs relating to this are displayed. Additional signs are also displayed in relation to the restriction of alcohol sales to intoxicated persons.
Only photographic driving licence, valid passport, MOD/HM Forces ID card or proof of age card bearing the holders photo and the PASS hologram will be accepted as proof of age.
A refusals register is kept at the premises in which all refusals of alcohol sales for reasons of age or intoxication are documented. This is made available upon reasonable request to a police officer or other authorised officer for inspection.
The premises staff, where it is safe and appropriate for them to do so, politely encourage the dispersal of customers or other groups who gather directly outside of the premises in order to discourage anti-social behaviour from the vicinity, and actively liaise with the police and town centre wardens where they identify issues of anti-social behaviour that are beyond their ability to safely control.
No sales of canned or bottled beer, lager or cider in quantities of less than two.
No sales of cider or beer above 6% abv.
No single sales of spirits in quantities of less than 35 cl.
The hours for the sale of alcohol by retail be 10:00 to 00:00 Monday to Sunday.
A personal licence holder be present at the premises when licensable activities are taking place.
Licensing Committee Conditions Review 17th April 2018
A minimum of two bottles or cans of Beer, Larger or Cider shall be sold at any one time and a notice informing customers of this condition must be displayed.
Notices shall be prominently displayed by the entry/exit door and counter advising that CCTV & Challenge 25 are in operation;
Advising customers of the provisions of the Licensing Act regarding underage sales and proxy sales;
A notice asking customers to respect nearby residents, to leave quietly , not to drink outside the shop, in the street or loiter outside the shop must be displayed.
A Notice stating no alcohol must be consumed in the shop at any time must be displayed.
An incident book will shall be kept at the premises, and made availiable to any authorised officer, which will record the following;
All crimes reported
Lost property
All ejections of customers
Any complaints received
Any incidents of disorder
Any seizure of drugs or offensive weapons
Any faults in the CCTV
Any refusal for sale of alcohol
Any visit by a relevant authority or emergency service
A CAD number where police are called.
The premises licence holder must be able to produce to a police officer, UK Border Agency Officer or Authorised Officer proof of full compliance with the current Home Office guide for employers on preventing illegal working in the the UK, currently titled " An employers guide to right to work checks".
The premises licence holder must maintain a written record of the hours worked by all persons subject to immigration control. Such a record shall as a minimum cover the previous four weeks and must be availiable to produce on demand to a Police Officer, UK Border Agency Officer or Authorised Officer.
A fire risk assesment and emergency plan will be prepared and regularly reviewed. Staff will be trained in respect of fire safety.
The shop front will be kept tidy at all times and shall be swept at close.
No deliveries will be received, or glass and other waste removed between 20:00 and 07:00.
Staff will be trained on induction and given refresher training at three monthly intervals in the operation of Challenge 25. Training will include identifying persons under 25, making a challenge, acceptable proof of age and checking documents, making and recording a refusal of sale, not serving intoxicated persons, avoiding conflict, responsible alcohol retailing, operating the CCTV system and downloading images and safeguarding children.
All training a year from 17th April 2018 (date of review) will be undertaken by a competant external provider.
A written training record will be kept for each staff member and will be made availiable to the Police or Authorised Officer on request.
