Additional Conditions

• MANDATORY CONDITIONS.

  The following mandatory conditions are to be applied to the licence stated above in accordance with section 3 (1) of The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010.

   

  The following conditions shall come into force on 6th April 2010

   

  1. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

     (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carrries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

                (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

                             

                              (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the perod in which the responsible person is authorised to sell or supply alcohol), or

                              (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

                (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in seciton 159 of the Act;

                (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the pruchase and consumption of alcohol over a period of 24 hours or less;

                (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

   

                              (i) the outcome of a race, competition or other event or process, or

                              (ii)the likelihood of anything occurring or not occurring;

   

                (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  The following mandatory conditions are to be applied to the licence stated above in accordance with section 3 (1) of The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010.

   

  The following conditions shall come into force on 1st October 2010

   

  4. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

     (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  5. The responsible person shall ensure that-

   

                (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having ben made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

   

                              (i)   beer or cider: 1/2 pint;

                              (ii)  gin, rum, vodka or whisky: 25 ml or 35 ml; and

                              (iii) still wine in a glass: 125 ml; and

               

                (b) customers are made aware of the availability of these measures.

   

   

   

   

   

• ANNEX 1 - MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises supply of alcohol

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in                          respect of the premises licence, or 

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

• Licensing Objectives

   

  Below are the additional steps that you have agreed to undertake to promote the four Licensing Objectives and which form a part of the operating schedule for these premises: -

   

  To implement and maintain a security system utilising access cards to ensure authorised persons only have access to the facilities.

   

  To maintain a CCTV system compliant with police requirements and to have a trained person who can access recorded material should it be required by a police officer or an officer from a responsible authority. Recorded material will be kept for 30 days.

   

  Licensable activities will only take place within the areas identified on the site plan, and patrons and guests will only be allowed in those identified areas apart from the use of toilets and in an emergency evacuation situation.

   

  All alcohol sales are restricted to those attending events.

   

  Challenge 25 will be utilised in respect of all alcohol sales.

   

  All staff will be trained in relevant licensing issues and a training wregister will be kept up to date detailing which and when staff are trained.

   

  All alcohol will be stored securely in a seperate area

   

  There will be a security presence at all times that the identified areas are in use for licensable activities.

   

• Conditions agreed relating to Noise

   

        A concert shall be termed an event of which the main purpose is to provide Regulated entertainment to an audience of 1000 persons or greater. The provision of such events will be limited to the Courtyard area only to which the following conditions shall apply.

   

  1.              The number of Concert Events per year shall not exceed 4.

  2.              Concerts shall not be held on more than 3 consecutive days.

  3.              The maximum music noise level during a Concert shall not exceed LAeq,15 min 65 dBA at the boundary of any nearby housing.  The equivalent level at the mixing desk may be determined, by measurement or verified prediction, and the principle monitoring may be carried out from there.

  4.              Any Concert shall last no longer than 4 hours in duration.

  5.              The Concert organiser shall employ a suitably qualified noise consultant to provide monitoring and control of the noise levels.  The Consultant shall submit a report verifying that the noise condition above has been complied with.

  6.              Concert events, including the times of sound checks shall be notified to local residents living within a 300m radius of the boundary of courtyard area at least 2 weeks prior to the concert.

  7.              The sound system shall only be tested at a Music Noise Level that is audible off site

  a.              between midday and 18:00 hours on the day prior to the event for a maximum of 2 hours

  b.              between 11:00 and 18:00 on the day of the event for a maximum of 2 hours

  8.              Any activities in connection with a Concert that are audible at any nearby residential properties, such as build up and take down of the stage and event infrastructure, “bottling out” and refuse collections, shall only be carried out between

  a.              08.00 and 20.00 hours on the Monday to Saturday

  b.              09.00 and 20.00 hours on Sundays

   

  B.              All other events where Regulated entertainment is to be performed in front of an audience of less than 1000 persons shall not be limited in number. However where amplification of music or the spoken word is provided as part of the Regulated Entertainment this shall be played in such a manner so as not to give reasonable cause for annoyance at the boundary of any nearby residential property.

  C.              Events held on the college playing fields where Regulated Entertainment is to be provided shall be limited to 2 events per year. Regulated entertainment shall be provided for a duration not exceeding 3 hours, and shall be limited between the hours of 12.00 - 18.00. Regulated entertainment is only to be provided in connection with community and college fun days.

  D.              During the provision of any regulated entertainment indoors, where reasonably practicable, all doors and windows shall remain closed.
