• ANNEX 1 - MANDATORY CONDITIONS

   

  Mandatory conditions where licence authorises supply of alcohol

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in                          respect of the premises licence, or 

   

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

• ANNEX 1 - MANDATORY CONDITIONS

   

  Mandatory condition: exhibition of films

   

  (1)              Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.

   

  (2)              Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  (3)              Where -

   

  (a)              the film classification body is not specified in the licence, or

  (b)              the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,

   

  admission of children must be restricted in accordance with any                  recommendation made by that licensing authority.

   

  (4)              In this section -

   

                “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39)

  (authority to determine suitability of video works for classification).

• NOISE CONDITIONS OF LICENCE

   

  1.  Outdoor events with live and recorded music shall comply with clause 3.3 of the Council's Policy for the avoidance of Public Nuisance.

   

                3.3  The licensee shall ensure that the volume of noise due to music and                                     singing and fixed plant and equipment shall be so controlled by the

                      licensee so as not to give reasonable cause for annoyance.

                        Notwithstanding the above, any noise shall not be audible within any

                        noise sensitive premises.

   

                        Where this has been breached, the licensee will review the noise

                        control measures that are in place and implement a revised scheme that

                        has been agreed with the Licensing Authority.

   

  2.  Certain types of events may be considered major events.  Major events are deemed to be those events which might breach clause 3.3, such as Pop Concerts, Dances and Discos, and are expected to attract large numbers of people.  It is not the Council's intention to prevent such events altogether and therefore the following conditions shall apply to major Events.

   

                2.1  The number of Major Events per year shall not exceed four.

   

                2.2  The date and start time of each Major Event shall be notified to the

                        Council at least seven days in advance of each event.

   

                2.3  The maximum music noise level during a Major Event, for live and

                        recorded music, shall ot exceed 65dBA1 at the boundary of the

                        nearest noise sensitive premises.

   

                2.4  A Major Event shall cease no more than four hours after the start time

                        notified in Clause 2.2 above but must comply with Clause 2.5 below.

   

                       A Major Event may be in addition to other activities on the same day that

                       involve live or recorded music, provided those other activities comply

                       with Clause 3.3 of the Councils Policy on the avoidance of Public

                       Nuisance and Clause 2.5 below.

   

                2.5  Live or recorded music shall not be audible at the boundary of any

                        noise sensitive premises after 2300 Monday to Saturday, or after

                        2230 on a Sunday.

   

   

• Licensing Objectives

   

  Below are the additional steps that you have agreed to undertake to promote the four Licensing Objectives and which form a part of the operating schedule for these premises: -

   

  General -

  NAC will not only operate this facility with clear and strong management but all users and occupiers must be members of the collective and adopt the collective ethos to ensuring safety and comfort and security to visitors and local businesses and residents.

  Prevention of Crime & Disorder -

  Curator/duty manager in attendance at all times.  Supplemented by volunteer stewards & hired in security staff for certain events.  Also written policy for unit occupants, clear dialogue with market office & police.

  Public Safety -

  Adherence to all H&S/fire precautions/local authority guideline & regulations, clear signage.  Clear safety policy - liason with police - pubwatch scheme.

  Prevention of Public Nuisance -

  We aim to offer a safe, secure, high quality public arts facility - any problematic visitors will be dealt with calmly & promptly.  Discharge times will be carefully monitored.

  Protection of Children from Harm -

  On site management at all times.  Clear policies on access by children if shows contain challenging material.
